Applies to: The private online community operated by BrainPassion Kids LLC (the “Company”), doing business as the BrainPassion Community (the “Community,” “we,” “our,” “us”).

We are committed to protecting your privacy. This policy explains what we collect, how we use it, when we share it, and the choices you have.

1) Scope & Who This Covers

This policy applies to information we collect through:

  • Our Community platform (including hosted discussion areas, events, messages, and replays)

  • Our websites and checkout pages

  • Email and form submissions

  • Any related services, programs, or digital products we provide

This policy does not cover third-party websites or services that we don’t control. Their practices are governed by their own privacy policies.

2) What We Collect

A. Information You Provide

  • Account & Contact Info: name, email address, password, and similar details when you sign up.

  • Profile & Posts: information you add to your profile; content you post in groups, comments, chats, or forms (including text, images, and attachments).

  • Program Interactions: survey responses, support requests, and messages to us.

  • Recordings Consent: if you participate in live calls that are recorded, your name, image, voice, and any content you share may be captured.

B. Payment Information

  • Payments are processed by third-party providers (e.g., Stripe, Squarespace Commerce, the Community host).

  • We do not store full credit card numbers on our servers. Limited details (e.g., last 4 digits, expiration month/year) may be visible to manage subscriptions, invoices, and refunds.

C. Automatically Collected Data

  • Device & Log Data: IP address, browser type, device identifiers, pages viewed, timestamps, and referring/exit pages.

  • Cookies & Similar Technologies: used for login, session integrity, analytics, and basic site functionality. See Section 8 for controls.

D. From Third Parties

  • Platform Providers & Integrations: our Community host, email service, analytics tools, or payment processors may send us information needed to operate your account (e.g., successful payment, subscription status).

3) How We Use Your Information

We use your information to:

  • Provide Services: create/manage your account; deliver programs, courses, calls, downloads, and community access.

  • Communicate: send service messages, program updates, resources, and support emails; respond to inquiries.

  • Improve & Secure: analyze engagement and usage to improve content, troubleshoot, and maintain platform security.

  • Administer Payments: manage subscriptions, billing, receipts, and access control.

  • Comply with Law: enforce our Terms, prevent fraud/abuse, and meet legal or regulatory obligations.

We do not use your content for external advertising or sell your personal data.

4) Legal Bases (EEA/UK only)

If you are in the EEA/UK, we process your data under these legal bases:

  • Contract: to provide the services you requested.

  • Legitimate Interests: to secure and improve our services and community experience.

  • Consent: for optional communications or recording participation (where required).

  • Legal Obligation: to meet applicable laws (e.g., tax, bookkeeping).

You may withdraw consent at any time where consent is the basis.

5) When We Share Information

We share information only as needed to run the Community and comply with the law:

  • Service Providers: platform host, payment processors, email providers, analytics/security vendors (bound by contractual confidentiality and data-use limits).

  • Legal & Safety: to comply with lawful requests, enforce our Terms, or protect rights, safety, and security.

  • Business Transfers: in a merger, acquisition, or asset sale, information may transfer as part of that transaction, subject to this policy.

We do not sell or rent your personal data. We do not “share” personal information for cross-context behavioral advertising as defined by some state laws.

6) Community Content & Recordings

  • Community Posts: what you share in the Community can be seen by other members in those spaces. While we set rules against screenshots and re-sharing, we cannot guarantee that other members will always comply. Share thoughtfully.

  • Events & Calls: live sessions may be recorded and made available to members for replays. If you do not wish to be recorded, keep your camera/mic off and avoid sharing personal details.

  • External Sharing: members may not download, repost, or sell call recordings. Short snippets or quotes may be shared externally only in line with our Community Policy and with any required permissions.

7) Your Choices & Rights

A. Communications

  • Unsubscribe: use the unsubscribe link in non-transactional emails or contact us to adjust preferences.

  • Service Messages: account, billing, or policy notices are transactional and may still be sent.

B. Access, Update, Delete

You may request to view, correct, or delete your personal information by emailing makayla@brainpassionkids.com.
We may retain certain information where required by law or for legitimate business purposes (e.g., tax records, security logs).

C. EEA/UK/California Rights

Depending on your location, you may have additional rights (e.g., access, deletion, portability, restriction, objection). To exercise these, email makayla@brainpassionkids.com and note your jurisdiction. We will verify your request as required by law.

8) Cookies & Tracking

We use cookies and similar technologies to:

  • Keep you logged in and secure your session

  • Remember preferences and improve performance

  • Measure basic analytics (page views, feature usage)

Controls:
You can manage cookies in your browser settings (blocking may affect functionality). Some browsers offer “Do Not Track”; there is no industry standard response, so we may not act on DNT signals.

9) Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information. No system is 100% secure. You are responsible for maintaining the confidentiality of your login credentials and for activity on your account.

10) Data Retention

We retain personal information while your account is active and as needed to:

  • Provide services and replays you are entitled to

  • Comply with legal, tax, or accounting requirements

  • Resolve disputes and enforce our agreements

When retention is no longer necessary, we will delete or de-identify your information consistent with our data practices.

11) Children’s Privacy

Our services are intended for adults (18+). Minors may participate only with parental enrollment and active supervision. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information to us, contact makayla@brainpassionkids.com and we will delete it.

12) International Users & Data Transfers

We operate in the United States. If you access the Community from outside the U.S., you understand that your information may be transferred to, stored, and processed in the U.S. and other countries which may have different data protection laws than your country of residence.

13) Third-Party Services & Links

Our Community may include links or integrations with third-party services (e.g., payment processors, the community host, video platforms). We do not control these services. Review their privacy policies to understand their practices.

14) Changes to This Policy

We may update this policy from time to time. Material changes will be reflected by an updated “Last Updated” date. Your continued use of the Community after changes means you accept the updated policy.
