Welcome to BrainPassion™ (the “Company,” “we,” “our,” or “us”). By using our website, education, products, community spaces (hosted on Mighty Networks™) and services, purchasing any program, or participating in any live or recorded session (collectively, the “Platform”), you agree to these Terms.

If you do not agree, do not access or use the Platform.

Our intention in sharing this is not to overwhelm you with “fine print” — but to set healthy boundaries. We believe clarity builds trust. BrainPassion™ exists to provide education, tools, and guidance for emotional regulation, brain-body connection, and learning support. We are not here to replace your doctor, therapist, or medical care team.

In Plain English:

We teach brain-based self-regulation; we are not your doctor or therapist.
Adults only may purchase. Kids/teens participate with a parent or guardian purchase.
All sales are final (unless stated otherwise). Subscriptions auto-renew until you cancel.
Please don’t copy, share, or repost our paid content.
Be kind. We remove users who violate community guidelines.
Terms may be updated. Using the platform = agreement to updates.

By continuing with our programs, you acknowledge you’ve read and understood these terms, and you agree to honor the spirit of this work: education, empowerment, and support.

1) About BrainPassion™ & the Founder

Makayla Wood is a certified Specialized Kinesiologist with training in brain–body regulation and movement science, and holds a B.A. in Psychology. She has years of experience as a long-term substitute educator supporting children, teens, and families across academic, behavioral, and emotional settings.

Our Methods & Modalities (What We Do)

Specialized Kinesiology (what it is): Specialized Kinesiology is an applied field that uses gentle, non-invasive techniques — such as muscle response testing, movement-based corrections, and brain-body integration exercises — to identify and release imbalances in the nervous system.
Unlike general kinesiology, which focuses on anatomy, fitness, and sports performance, Specialized Kinesiology focuses on how stress, emotions, and neurological patterns affect the body’s ability to regulate, learn, and function.
In our context, Specialized Kinesiology is used to:
- Support nervous system regulation
- Strengthen postural and motor patterns
- Improve coordination, rhythm, and timing
- Restore the brain–body connection for learning readiness and emotional balance
Light Therapy: education and non-medical wellness routines utilizing targeted light wavelengths intended to support mood, stress responses, and recovery. This is educational and self-care oriented, not a medical treatment.
Acupressure: non-invasive techniques applying light, manual pressure to specific points to support relaxation and self-regulation.
Brain-Based Education: interpreting behavior, learning, and emotional patterns through a neurological lens to teach practical regulation strategies and routines.

These elements inform the Regulation Method™, our 7-step, holistic brain–body system designed to support emotional development, behavior regulation, and learning readiness in children, teens, and adults.

Important: We provide education, coaching, and self-regulation tools. We do not provide medical, psychological, or therapeutic diagnosis or treatment.

2) Eligibility & Accounts

You must be 18+ to purchase services or join as an adult member.
Children/teens may participate only with parent/guardian enrollment, consent, and supervision.
You are responsible for safeguarding your login and for all activity under your account.

3) Educational Use Only (Not Medical Advice)

All content is for informational and educational purposes only. Nothing on the Platform constitutes medical, psychological, or therapeutic advice, diagnosis, or treatment. Always consult your licensed healthcare provider before starting or changing any health, wellness, or treatment routine, especially if you are pregnant, nursing, have photosensitivity, seizures/epilepsy, bipolar disorder, migraines, active injury, implanted devices, or other medical conditions.

Emergencies: This Platform is not a crisis service. If you are in danger or experiencing a medical or mental health emergency, call 911 (or your local emergency number) immediately.

4) Safety Disclosures for Light Therapy, Acupressure & Brain Exercises

By participating, you acknowledge and agree:

Light Therapy: Some individuals may be sensitive to light. Discontinue if you experience headaches, dizziness, agitation, or visual disturbances. Consult your provider if you have photosensitivity, a seizure history, skin conditions, or you are taking photosensitizing medications.
Acupressure: Avoid deep or sustained pressure on contraindicated points during pregnancy or with circulatory/skin conditions unless cleared by a clinician. Use gentle pressure only. Stop if you feel pain, tingling, numbness, or discomfort.
Movement/Brain Exercises: Ensure a clear, safe environment. Modify or stop if you feel pain, dizziness, or instability. Consult your provider before beginning any exercise program.

You agree to use your own judgment and take full responsibility for your participation.

5) Community Standards & Conduct

We aim for a regulated, respectful community. You agree not to:

Harass, bully, dox, or discriminate; share another person’s story without permission; or post harmful content.
Provide medical advice to members or solicit medical histories.
Upload malware or attempt to interfere with the Platform.
Record or redistribute paid content, live calls, or member posts without written permission.

We may remove content or users at our discretion for violations of these standards or these Terms.

6) Payments, Subscriptions, Refunds & Access

All sales are final unless explicitly stated otherwise in the specific offer.
Payment plans must be completed to maintain access. Missed or incomplete payments may result in suspension or removal from private services, courses, or communities.
Subscriptions (e.g., monthly memberships) auto-renew until canceled. Cancel at least 24 hours before the next billing date to avoid renewal. No partial refunds for unused periods.
Chargebacks: Initiating a chargeback without first contacting support may be treated as breach of these Terms and may result in account termination and/or collections processes.
Taxes: You are responsible for any applicable taxes.
Price/Offer Changes: We may change pricing or features prospectively at any time.

7) Intellectual Property & License

All content on the Platform—including videos, audios, printables, scripts, routines, graphics, worksheets, frameworks, methods, trademarks, and text—is owned by BrainPassion LLC or its licensors and protected by copyright, trademark, and other laws.

You receive a limited, revocable, non-transferable license for personal, non-commercial use only.
You may not copy, share, adapt, publish, sell, sublicense, or create derivative works without prior written permission.
The names BrainPassion™, Regulation Method™, Seven Essential Needs Framework™, Amygdala Alignment™, Amygdala Balance™, and related marks are trademarks of BrainPassion Kids LLC.

If you believe your copyrighted work has been used on the Platform without authorization, contact us with a detailed notice and we will review and respond.

8) User Content, Recordings & Privacy

You own your content, but by posting or submitting it on the Platform (comments, posts, uploads, live call participation), you grant us a worldwide, non-exclusive, royalty-free license to host, display, and share it within the Platform for community and replay purposes.
Live sessions may be recorded to provide replays to members. If you do not wish to be recorded, keep your camera/mic off and avoid sharing personal information.
Although we use private community tools, we cannot guarantee confidentiality for anything you share in group spaces. Share wisely.

9) Testimonials, Examples & No Guarantees

Member stories, testimonials, or examples illustrate possibilities; they do not guarantee you will achieve the same results. Individual outcomes vary based on biology, environment, and consistent practice.

10) Third-Party Tools & Links

The Platform may reference third-party tools or contain links. We do not control or endorse third-party sites and are not responsible for their content, policies, or practices. Use at your own risk.

11) Modifications to the Platform or Terms

We may update content, programs, features, or these Terms at any time. Continued use of the Platform after changes means you accept the updated Terms. Material changes will be noted by an updated “Last Updated” date.

12) Disclaimers & Limitation of Liability

The Platform and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, BrainPassion Kids LLC and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of the Platform—even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid to us in the 90 days preceding the claim.

Some jurisdictions do not allow limits on implied warranties or liability; in those cases, portions of this section may not apply.

13) Indemnification

You agree to indemnify, defend, and hold harmless BrainPassion Kids LLC, its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

14) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Texas (without regard to conflict-of-laws rules).

Good-Faith Resolution: You agree to first contact us to attempt an informal resolution.
Arbitration/Class Waiver: If we cannot resolve a dispute informally, you agree to binding arbitration on an individual basis in Harris County, Texas, under the rules of the American Arbitration Association. No class actions or class arbitrations. Judgment on the award may be entered in any court with jurisdiction. You and we each waive any right to a jury trial.

If arbitration is unenforceable for a claim, you agree to the exclusive jurisdiction of state or federal courts located in Harris County, Texas.

15) International Users

We operate from the United States. If you access the Platform from other locations, you are responsible for compliance with local laws.

16) Termination

We may suspend or terminate your access at any time, with or without cause, including for any violation of these Terms. Upon termination, your license to use our content immediately ends.

17) Miscellaneous

Severability: If any provision is unlawful or unenforceable, it will be severed and the remaining provisions remain in effect.
No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Entire Agreement: These Terms, plus any offer-specific terms and our Privacy Policy, are the entire agreement between you and us regarding the Platform.
Headings: Headings are for convenience only.
